Travel Terms and Conditions

These Travel Terms and Conditions (hereinafter the "Terms and Conditions") is a part of the statement of transaction terms stipulated in Article 12-4 of the Travel Agency Act and also the contract documents in Article 12-5 of the Act. Please be sure to read the "Terms and Conditions" before applying for the event.

Article 1 [Agent-Organized Tour Contract]
(1) This tour is planned and conducted by Impression Co., Ltd. (Kanagawa Governor Registered Travel Agency No. 2-1203; LANDMARK TOWER 19F, Minato Mirai 2-2-1, Nishi-Ku, Yokohama, Kanagawa; hereinafter the "Company", "we", or "our") for Classic Japan Rally 2023 SEVEN STARS in KYUSHU <Rally> (hereinafter the "Event") organized by General Incorporated Association Classic Japan Rally, and participants of the Event will conclude an agent-organized tour contract (hereinafter the "Tour Contract") with the Company.
(2) The Company undertakes tour arrangements and itinerary management so that the participants may receive travel-related services including transportation and accommodation (hereinafter the "Travel Services") in accordance with an itinerary established by the Company.
(3) In addition, the contents and conditions, etc. of the contract conform to the website, the tour advertisement (the participation guide), the Terms and Conditions document, the final documents (the event guideline documents) provided separately to the participants prior to departure, and the Company's travel terms and conditions (for agent-organized tour contract).
Article 2 [Application and Validity of Application]
(1) To apply, you will be required to enter your name, contact information, and other necessary data on the entry sheet and submit it to the Company.
(2) Applications may be accepted by mail, fax, or other means of communication. In such cases, the contract has not been concluded at the time of booking, and your application will be valid and effective once the Company has confirmed your payment of the travel fee into the bank account specified by the Company after your application has passed the screening, and you will be qualified as a participant in accordance with the Terms and Conditions.
(3) The Company will approve your application by sending you a receipt for your application by mail.
Article 3 [Conditions for Application]
(1) Your application will NOT be accepted if the information provided in the application is inadequate or if you fail to submit all the documents required for the application.
(2) The driver must be at least 25 years old and hold a driver's license for a full-size or larger automobile. The co-driver must be at least 20 years old. If the registered driver and co-driver meet these requirements and both hold a driver's license, they may take turns to drive during the rally. Any applicant not meeting the age requirement will only be permitted to participate in the Event with the approval of the Company.
(3) You may be accompanied by a support vehicle for the maintenance, etc. of your rally car. Assistants and a support vehicle must be registered with the Event secretariat. A classic car such as the rally car, a large vehicle, or a vehicle with a carrier attached to the rear side of an ordinary car may not be used as a support car.
*Support staff members may stay at a different hotel from the one where their driver and co-driver stay.
(4) All participating rally cars and support vehicles must be covered by valid compulsory automobile liability insurance and voluntary insurance during the period of the Event. Vehicles brought from outside Japan must also be covered by insurance that is valid in Japan. Some insurance companies providing voluntary insurance for the participants may require a special policy such as a rally rider. All participants must confirm the validity of the insurance for their rally cars and support vehicles with their insurance provider before the start of the Event and ensure that the vehicles are covered by valid insurance during the Event.
(5) The participants will be responsible for any traffic accident, property damage, injury, death, or disease caused by them or their assistants on private premises other than a public road, and will be liable for any damage irrespective of compensation coverage provided by the insurance of the participants or their assistants.
*You will be required to present a valid insurance document during the Event.
(6) In principle, your participating vehicles may not be replaced after your application is accepted, except where a replacement is approved by the Company.
Please follow the Company's decision on your participant number after the replacement of your participating vehicle.
(7) If you violate any rule under the Terms and Conditions, either before or during the Event, you must leave the decision as to whether you may continue to participate in the Event to the Company.
(8) The Company may refuse your participation if it deems that you have caused any problems with other participants or prevented the efficient operation of the group activities.
(9) The Company may refuse your participation if it deems that you are not fit to participate in the Event for any other reason.
(10) Your application may not be accepted if the maximum number of applications has been reached.
(11) Vehicles manufactured in or before 1945 will be prioritized over vehicles manufactured in or after 1946 in the parking area, guidance, etc.
Article 4 [Travel Fee]
(1) You will be required to pay the travel fee by the date and by the method prescribed by the Company.
(2) The travel fee includes accommodation fee, meals, and commemorative gifts for the driver and the co-driver specified in the itinerary.
(3) Transportation and accommodation fees between your home and departure and arrival points, personal expenses such as additional food and drink, and their associated taxes and service charges are not included.
(4) Change of travel fee
Even after concluding a Tour Contract, the Company will change the travel fee in the following cases:
(4-1)If the fares or charges of transportation to be used are revised drastically beyond the amount normally assumed due to a significant change in economic conditions, etc., the Company will revise the travel fee only by the difference. In the case of increase of the travel fee, the Company will notify the participants no later than the 15th day prior to the day before the tour start date;
(4-2)If the cost of conducting a tour whose contents have been changed is increased or reduced, the Company may revise the travel fee accordingly.
Article 5 [Event Operation, Change of Rally Route, and Change of Schedule]
(1) In the operation of the Event, the participants must leave any decision to change the rally route or schedule to the Company.
(2) Change in contents of Tour Contract
Even after concluding a Tour Contract, in the event that a natural disaster, a war, a riot, suspension of Travel Services provided by transportation and accommodation facilities, etc., an order of a public office, provision of transportation services not scheduled in the original operating plan, or other event beyond the Company's control occurs, the Company may change the itinerary and the contents of the Travel Services if it is unavoidable in order to secure the safe and efficient operation of the tour, after immediately explaining the reason why the event concerned is beyond the Company's control and the causal relationship with the event concerned to the participants. However, if it is unavoidable in an emergency, the said explanation will be given after the changes have been made.
(3) Replacement of participant
If the driver or co-driver needs to be replaced by an unregistered third party due to unavoidable circumstances during the Event, the participants must follow the decision of the Company. Prizes will be given to participating vehicles, and drivers and co-drivers will still be eligible for the prizes even after replacement. In addition, transfer of the status under the contract will take effect when the Company approves, and thereafter, the person who has taken over the status under the Tour Contract will succeed all rights and obligations relating to this Tour Contract. However, the Company may refuse the replacement for some reasons, for example, transportation and accommodation facilities, etc. to be used do not accept the replacement of the travelers.
Article 6 [Cancellation Fee and Refund of Travel Fee]
(1) You must pay a cancellation fee at the following rate to cancel your participation for any reason attributable to you after your application is accepted. Any bank transfer fee or registered mail postage will be deducted from the refund amount.
《Date of notification of cancellation and cancellation fee》
【1】No later than the 21th day prior to the day before the tour start date … Free of charge
【2】20 to 8 days prior to the day before the tour start date, 10 to 8 days for one-day trip (excluding [3] ~ [6]) … 20% of travel fee
【3】7 to 2 days prior to the day before the tour start date (excluding [4] ~ [6]) … 30% of travel fee
【4】On the day before the tour start date … 40% of travel fee
【5】On the tour start date … 50% of travel fee
【6】After starting tour or failure to show without notice … 100% of travel fee
(2) All decisions regarding any change to the rally route, Event dates, time schedule, etc., reduction of the schedule, cancellation of the Event, etc. due to a natural disaster, social situation, force majeure, and other reasons not attributable to the organizer that occur before or during the Event will be made by the Company, and the participation fee will not be refunded.
However, if the Company decides to cancel the Event for the reason of preventing coronavirus infection, we will refund the total amount after deducting bank transfer fee and registered mail fee from the travel fee you have already paid.
(3) Cancellation before starting tour
(3-1)Cancellation by participant
【1】The participants may cancel the Tour Contract at any time by paying the cancellation fee written in Article 6 (1).
【2】The participants may cancel the Tour Contract without a cancellation fee in any of the following cases:
a. If the contents of the Tour Contract are changed in accordance with Article 5 (2);
b. If the travel fee is increased in accordance with Article 4 (4-1) and (4-2);
c. If a natural disaster, a war, a riot, suspension of Travel Services provided by transportation and accommodation facilities, etc., an order of a public office, or any other event occurs and the safe and efficient operation of the tour has become impossible, or if it is highly likely to become impossible;
d. If the tour operation in accordance with the itinerary written in the tour advertisement (the participation guide) or on the website becomes impossible due to any reason attributable to the Company, etc.
(3-2)Cancellation by the Company
【1】If the participant has not paid the travel fee by the prescribed date, the Company, etc. may cancel the Tour Contract. In that event, the participant must pay the same amount as the cancellation fee stipulated in Article 6 as a penalty.
【2】The Company, etc. may cancel the Tour Contract in any of the following cases:
a. If the participant does not satisfy the gender, age, qualification, skill or other requirements specified in advance by the Company, etc., or if it becomes evident that the participant does not satisfy the requirements;
b. If it is deemed that the participant is unfit for the tour due to illness, absence of a necessary caretaker, or any other reasons;
c. If it is deemed that the participant might cause any problems with other customers or prevent the efficient operation of the group tour;
d. If a natural disaster, a war, a riot, suspension of Travel Services provided by transportation and accommodation facilities, etc., an order of a public office, or any other event beyond the control of the Company, etc. occurs and the safe and efficient operation of the tour in accordance with the itinerary written on the website or in the tour advertisement (the participation guide) has become impossible, or if it is highly likely to become impossible;
e. If the number of participants is less than the minimum number of participants written on the website or in the tour advertisement (the participation guide). In that case, we will inform the participants of the cancellation of the tour no later than the 13th day (the 3rd day for one-day trip) prior to the day before the tour start date;
f. If the participant demands things that are beyond the reasonable extent regarding the contents of the contract;
g. If the conditions for conducting the tour specified in advance by the Company, etc. are not fulfilled, for example, a lack of snowfall on a ski tour, or if it is highly likely not to be fulfilled.
【3】If the Company cancels the Tour Contract, we will refund the amount after deducting a penalty from the travel fee (or the application fee) we have already received. In addition, if we cancel the Tour Contract under [2] in this Paragraph (3-2), we will refund the full amount of the travel fee (or the application fee) we have already received.
(4) Cancellation after starting tour
(4-1)Cancellation by participant
If the participant withdraws from the tour for personal reasons, they are deemed to have waived the right as a participant and no refund will be given. Even after starting the tour, if certain Travel Services cannot be provided in accordance with the contract documents for reasons not attributable to the participant, the participant may cancel that portion of the contract related to the Travel Services not provided without paying a cancellation fee. In that event, the Company will refund, out of the travel fee, the amount for only that portion related to the Travel Services not provided.
(4-2)Cancellation by the Company
【1】The Company may cancel a portion of a Tour Contract in any of the following cases after giving a reason to customers:
a. If it is deemed that the participant is unable to continue the tour due to illness, absence of a necessary caretaker, or any other reasons;
b. If the participant does not satisfy the gender, age, qualification, skill or other requirements specified in advance by the Company, or if it becomes evident that the participant does not satisfy the requirements;
c. If the participant corrupts the discipline of a group tour and prevents the safe and efficient operation of the tour through violation of the instructions of the Company given by a tour conductor or any other person for the safe and efficient operation of the tour, or through violence or threat, etc. against those persons or other accompanying participants;
d. If a natural disaster, a war, a riot, suspension of Travel Services provided by transportation and accommodation facilities, etc., an order of a public office, or any other event beyond the Company’s control occurs and the tour cannot continue.
【2】If the Company cancels the Tour Contract for the reasons written in [1] in this Paragraph (4-2) and there is a cancellation fee, a penalty, or any other expense which has already been paid or must be paid to a provider of the Travel Services which could not be provided due to the cancellation of the contract, the participant shall bear the fee. In that event, the Company shall refund the participant, out of the travel fee, the amount after deducting cancellation fees, penalties, and any other expenses the Company has paid or must pay to the said Travel Service provider from the expense for that portion of the Travel services which has not yet been provided to the participant.
【3】If the Company cancels the Tour Contract under a or d in [1] in this Paragraph (4-2) , we will make necessary arrangements for the participant to return to the starting point at the expense of the participant upon their request.
【4】If the Company cancels the Tour Contract under the stipulation [1] in this Paragraph (4-2), the contractual relationship between the Company and the participant will be extinguished only at and after the time of the cancellation. Therefore, the obligation of the Company regarding the Travel Services which have already been provided to the participant is deemed to have been validly performed.
Article 7 [Responsibility of the Company and Disclaimer]
(1) In performing a Tour Contract, if the Company or a business agent of the Company causes damage to a participant intentionally or by negligence, the Company shall compensate for the damage, but only if the Company is notified within 2 years from the day following the date of occurrence of the damage.
(2) If the participant suffers damage for any of the following reasons, the Company shall not be responsible for (1) in this Paragraph.
【1】Natural disaster, war, riot, or changes in the itinerary or cancellation of the tour due to such events
【2】Damage caused by accident or fire of transportation and accommodation facilities, etc.
【3】Suspension of services provided by transportation and accommodation facilities, etc., or changes in the itinerary or cancellation of the tour due to such events
【4】Orders of a public office, isolation due to a contagious disease, or changes in the itinerary or cancellation of the tour due to such events
【5】Accident during free time
【6】Food poisoning
【7】Theft
【8】Delay, interruption, schedule change, route change, etc. of transportation, or changes in the itinerary and reduction of time spent at destinations due to such events
(3) Notwithstanding the provision of the damage notification period of participants in this Paragraph (1), the Company shall compensate for damage caused to baggage referred to in this Paragraph (1), but only if the Company is notified within 14 days from the day following the date of occurrence of the damage. However, regardless of the amount of damage, the Company shall compensate up to 150,000 yen per person (except if damage is caused intentionally by the Company or through serious negligence.).
Article 8 [Special Compensation]
(1) Regardless of whether or not the Company is responsible, in accordance with the special compensation regulations of the Company’s term and conditions, the Company shall pay the following compensation for damage to your life or body suffered within 180 days of the accident due to an unexpected and sudden external event during your participation in an agent-organized tour: compensation for death (15 million yen per participant), compensation for residual disabilities (up to 15 million yen per participant), consolation payments for hospitalization (20,000~200,000 yen per participant, depending on the number of days), and consolation payments for hospital visits (10,000~50,000 yen per participant). In addition we shall pay compensation for damage to baggage (up to 100,000 yen per item or pair of items, and up to 150,000 yen per customer per agent-organized tour). If you have an insurance which covers damage to baggage, the Company may reduce the amount of damage compensation to be paid by the Company.
(2) Regardless of (1) in this Paragraph, on days where no Tour Service included in an agent-organized tour arranged by the Company is provided, only if the said effect is specified on the the website or the brochure, you will not be deemed to be participating in the agent-organized tour.
(3) The Company shall not pay compensation for items excluded from compensation for damage such as cash, securities, credit cards, licenses, deposit certificates/savings certificates (including bankbooks and ATM cards), various data and other equivalents, contact lenses, cash vouchers, and valuables, etc. which should be managed by the participant.
(4) Even if the Company has both the obligation to pay compensation and that to compensate for damage under (1) in this Paragraph, if either of the obligations is performed, it will be deemed that both the obligation to pay compensation and that to compensate for damage have been performed to the extent of the amount.
Article 9 [Responsibility of Participant]
(1) If the Company suffers any damage caused by intentional, negligent, or illegal acts, acts that violate public order and morals, or violation of the Company’s terms and conditions by a participant, the participant shall compensate the Company for such damage.
(2) When concluding an agent-organized tour contract, the participant must endeavor to understand the rights and obligations of a participant, as well as other contents of the agent-organized tour contract by utilizing the information provided by the Company.
(3) In order to efficiently receive the Travel Services written in the contract documents, in the event that the participant has realized that different Travel Services from those written in the contract documents have been provided after starting the tour, they must promptly inform the Company or the Travel Service provider of that effect at the destination.
Article 10 [Guarantee of Itinerary]
(1) If an important change in the contents of the contract listed in the left column of the following table or any change due to a shortage of transportation seats or guest rooms and other equipment of accommodation even though transportation, etc. provide the Travel services included in the contract occurs (excluding the changes stipulated in the following [1], [2] and [3]), the Company shall pay a change compensation, calculated by multiplying the "travel fee" stipulated in Article 4 by the ratio written in the right column of the following table, within 30 days from the day following the date of completion of the tour to the participant.
【1】Changes caused by event beyond the Company's control, adverse weather conditions, natural disaster, war, riot, orders of a public office, suspension of services provided by transportation and accommodation facilities, etc., and provision of transportation services different from the original schedule. Necessary measures to ensure the safety of the life and body of tour participants.
【2】Changes related to the canceled portion of a Tour Contract when the Tour Contract is canceled.
【3】Even if the order in which Tour Services are provided changes, when all services are provided during the tour.
(2) However, the amount of a change compensation paid for one Tour Contract is up to 15% of the travel fee. In addition, if the amount of a change compensation for one Tour Contract is less than 1,000 yen per person, the change compensation will not be paid.

【5】Change of the type or the name of accommodation written on the application site and in the final documents (excluding if the grade of the changed accommodation is higher than that of the accommodation written on the contract documents when the Company has set the accommodation grade.) Article 11 [Handling of Personal Information]
(1) The Company will not use the personal information collected for the Event for any purpose other than the following:
・Inclusion in the Event program
・Announcements, etc. at the Event venue
・Posting on a bulletin board in and/or outside the Event venue
・Posting on the official website of the Event
・Posting on the official social networking websites of the Event
・Posting on other notifications related to the Event
(2) We will use personal information collected for the Event for the purpose of use stated at the time of collection, or will use the information for other purposes that are reasonably relevant to the original purpose only to the extent necessary for carrying out our business activities. In addition, when jointly using personal information with a third party or entrusting the handling of personal information to a third party, we will supervise the partner of joint use and the third party to ensure proper use of personal information.
(3) We collect, use, manage, and store personal information of users properly, and provide it to the event sponsors as necessary.
Article 12 [Use of Audio, Video and Photo Records]
(1) The organizer and its affiliates reserve all rights to the use of videos and photographs of the Event taken with television cameras, movie cameras, still cameras, etc.
(2) The results of the rally will be announced on the website of Classic Japan Rally. The records will be maintained on the website as archives and released through a record search from the following year.
(3) The rally results will be published in the Event report.
(4) The Event will be covered by the media such as newspapers.
Article 13 [Regarding Terms and Conditions of Agent-Organized Tour Contract]

Matters not stipulated in the Terms and Conditions comply with the Company' travel terms and conditions (for agent-organized tour contract). If you would like our travel terms and conditions, please request our office.

Article 14 [Revision of Travel Terms and Conditions]

The Terms and Conditions was created based on February 7, 2022.
The Terms and Conditions may be revised as necessary. Any revision of the Terms and Conditions will apply to the tour.

Pledge

I hereby pledge to obey all of the following rules and regulations as a participant in "Classic Japan Rally 2023 SEVEN STARS in KYUSHU <Rally>" (hereinafter, the "Event") to be held from November 25 to 28, 2023 on the day before and during the period that the Event is held.

1) During the period that the Event is held, as a participant, I shall comply with the Constitution of Japan, the Road Traffic Act and all applicable laws and regulations, always drive safely and observe the competition bylaws and rule books of the Event.
2) I am physically and mentally healthy.
3) During the period that the Event is held, should an incident or accident in which I am a victim or a person responsible for the incident or accident occur (theft of a participating vehicle, death or injury caused by a traffic accident, a traffic accident involving third parties, etc., or a participant becoming ill, loss of personal belongings, etc.), I shall promptly report to the nearest police station and fire station and the management office of the Event, address the situation and accept full responsibility, and shall not cause any problem or trouble to the organizers of the Event and the parties concerned.
4) Should another participating vehicle fall under the conditions described in 3) above and it is deemed difficult for the person(s) in that vehicle to report to the police station and fire station and the management office of the Event, I will report it to the police station and fire station and the management office of the Event for the person(s).
5) Fire extinguisher, which carries a hazard (emergency stop version) at the time of failure.
6) During or before the period that the Event is held, I shall entrust to the organizers of the Event all decisions on changes, shortening, cancellation, etc. of the route, dates, schedule of the Event due to natural disasters, social situations, force majeure and other reasons for which the organizers of the Event are not responsible, and shall not demand a refund of the participation fee.
7) If I decide not to participate in the Event due to personal reasons after I apply for participation, I shall not demand a refund of the participation fee.
8) I delegate all authority to the organizers of the Event regarding the use of video and photographic materials from television cameras, movies, still cameras, etc., shooting the scenes of the Event as well as regarding the use of recorded sound materials.
9) I shall communicate with other participants, residents of the locations where the Event is held and parties concerned, assume a polite and friendly attitude and exemplify being a participant of the Event.
10) I shall entrust decisions on changes in the route and schedule relating to the operation of the Event to the parties concerned.
11) I shall apply for and manage on my own responsibility a voluntary insurance that covers possible accidents causing death, injury, etc. of participants, fellow passengers and third parties as well as possible accidents causing property damage, including participating vehicles, vehicles of third parties and relevant facilities, which may occur during the period that the Event is held.
12) In the event that I am in violation of any of the items of this written pledge during the period that the Event is held, I will entrust the decision of my continued participation in the Event to the organizers and refrain from making any objection.

Pledge for Support Car

I hereby pledge to obey all of the following rules and regulations as a support crew for a participant in "Classic Japan Rally 2023 SEVEN STARS in KYUSHU <Rally>" (hereinafter, the "Event") to be held from November 25 to 28, 2023 on the day before and during the period that the Event is held.

1) During the period that the Event is held, as a participant, I shall comply with the Constitution of Japan, the Road Traffic Act and all applicable laws and regulations, always drive safely and observe the competition bylaws and rule books of the Event.
2) I am physically and mentally healthy.
3) During the period that the Event is held, should an incident or accident in which I am a victim or a person responsible for the incident or accident occur (theft of a participating vehicle, death or injury caused by a traffic accident, a traffic accident involving third parties, etc., or a participant becoming ill, loss of personal belongings, etc.), I shall promptly report to the nearest police station and fire station and the management office of the Event, address the situation and accept full responsibility, and shall not cause any problem or trouble to the organizers of the Event and the parties concerned.

7) If I decide not to participate in the Event due to personal reasons after I apply for participation, I shall not demand a refund of the participation fee.
8) I delegate all authority to the organizers of the Event regarding the use of video and photographic materials from television cameras, movies, still cameras, etc., shooting the scenes of the Event as well as regarding the use of recorded sound materials.
9) I shall communicate with other participants, residents of the locations where the Event is held and parties concerned, assume a polite and friendly attitude and exemplify being a participant of the Event.
10) I shall entrust decisions on changes in the route and schedule relating to the operation of the Event to the parties concerned.
11) I shall apply for and manage on my own responsibility a voluntary insurance that covers possible accidents causing death, injury, etc. of participants, fellow passengers and third parties as well as possible accidents causing property damage, including participating vehicles, vehicles of third parties and relevant facilities, which may occur during the period that the Event is held.
12) In the event that I am in violation of any of the items of this written pledge during the period that the Event is held, I will entrust the decision of my continued participation in the Event to the organizers and refrain from making any objection.
